The Terrorism Protection of Premises Bill, also known as Martyn’s Law is expected to become law in 2024. The legislation is in response to the 2017 Manchester Arena bombing and subsequent enquiry. The Draft legislation, developed from a consultation process, was in 2023, subject to scrutiny by the Home Affairs Select Committee.
The overall aim of the legislation is to improve protective security and organisational preparedness across the UK, by obliging event owners and organisers to consider the risk of terrorism and how they respond to an attack.
The legislation, as drafted, will apply to all premises with a capacity of 100 to 799 will be in a Standard Tier and all premises and events with a capacity of 800 or above in an Enhanced Tier. It will ensure premises are better prepared and ready to respond in the event of a terrorist attack. The measures to be taken will be proportionate and reasonable and in many cases will formalise best practice already in place. This formalisation will be done through a regulator with a table of sanctions. We at Crowd Angel were privileged to listen to the Rt Hon Tugendhat MBE VR MP, Minister of State for Security, address the Pool Re Market Event on 30 November 2023. The Minister confirmed that there would be a swift review of implications for those who are impacted by the legislation’s Standard Tier early in the year before introducing the legislation to Parliament in 2024; as announced in the King’s Speech on 7 November 2023. The format of this review is a short second public consultation period on a revised approach to the Standard Tier.
The object of the consultation on the standard tier is to ensure the Legislation has the right balance between public protection and avoiding undue burdens on smaller premises.
